TERMS AND CONDITIONS May 2018
These Terms and Conditions shall apply to all contracts for the sale of goods from FMR (Scale Models) Ltd T/A Frizinghall Models & Railways and the website www.modelrailshop.co.uk hereinafter called the ‘Company’ to the purchaser (the ‘Customer’) and shall comprise the only Terms and Conditions of contract between the Company and the Customer to the exclusion of all others. No variation of the Terms and Conditions shall be allowed unless expressly accepted in writing.
All orders accepted by the Company are subject to these Terms and Conditions.
The Company reserves the right to alter prices without prior notice.
For all orders made from the UK or European Union, 20% VAT is included in the price shown on the website. Orders from other countries are VAT free and the VAT content of the price will be deducted at checkout.
All scales and measurements are approximate only. Items on the Company website may be the subject of patents and registered designs. The Company reserves the right to withdraw or modify the design or specification of any item at any time without notice.
All published data of any kind by the Company relating to items on the Company website are approximate. No warranty or condition is given of accuracy. The Company accepts no liability for any loss or damage direct or indirect arising out of or in connections with this clause.
Orders are accepted by the Company subject to availability of stock. Acceptance of an order and therefore the existence of a contract of sale will only come into effect at the time when the Company undertakes delivery of items to the Customer.
All items are offered as being available. However, many manufacturers make limited quantities of their range, items listed can become unavailable without notice. If for any reason an item ordered is out of stock but will become available again shortly it can be sent as a follow on order. This will be advised on the invoice or by email.
The Company may at any time refuse or cancel the delivery of an order or balance of an order without notice.
Orders placed on the website can be paid by credit or debit card only. An order cannot be completed on the website unless card details are provided. A third party provider is used to process card transactions via a secure payment portal. The Company does not have direct access to your card details. In the event an order cannot be completed in full or part, an appropriate refund will be made direct to your card via the third party provider. Please refer to the Company Privacy Notice for further information.

Orders are normally processed within 1 – 2 business days of the order being placed. Please allow a further 2 – 3 days for delivery. If an email address is provided the Company will inform the Customer if there is any delay.
All UK deliveries are subject to a postal charge based on the value of the goods being purchased and are sent by either Royal Mail or next day delivery carrier of our choice. Postal charges are shown at checkout. Signed for mail will be used for high value items. Postage charges can also be seen on the delivery tab.
Overseas parcels are sent by insured air mail or carrier rate which ever is cheaper. Postage is calculated based on order value and is shown at check out.
Your rights to return goods are protected under the EU Distance Selling Directive which can be found at http://www.hmso.gov.uk/si/si2000/20002334.htm.
All products have a manufacturers guarantee or our own 30 day guarantee which ever is longer. All ‘new’ products have a manufacturers guarantee and all other items a 30 day return policy. This guarantee covers any component failure which is not due to misuse, modification or damage after delivery. Any damage in transit must be advised within 3 days of receipt. Any fault occurring at a later date and within the guarantee period, must be advised to us within the guarantee period prior to return. Customers must not tamper with or attempt to rectify faults without prior agreement.
Any item which is to be returned, must be packed well to avoid damage during transit. The Customer must contact the Company prior to any item being returned, for what ever reason, to authorise the return of the item(s). Items returned unwanted will not have the out bound or inbound postage refunded. Any items considered to be faulty should be returned by ‘signed for’ mail and the postage cost will be refunded if the item is deemed faulty on receipt. A letter must accompany all items being returned clearly stating the reason why and with details of the Customer.
The Company’s Privacy Policy sets out what information we hold about Customers, how Personal Data is used and our Marketing Policy.
If any of these conditions is, or at any stage in the future becomes invalid, illegal or cannot be enforced by law, it will not effect the other terms that will stay in force.
These Terms and Conditions shall be governed by and construed exclusively under the laws of England in the Courts of England and Wales.
